Here we are giving information about the types of surrogacy. Mainly two types of surrogacy have been considered-

Traditional Surrogacy

In this type of surrogacy, the sperm of the donor or father is matched with the eggs of the surrogate mother. Then the doctor inserts the sperm into the woman's uterus. In this, the woman who becomes pregnant is the biological mother of the child. During this type of surrogacy, in some cases, donor sperm can be used in place of the father and in such a case the father also has no biological relation with the future child.

Gestational Surrogacy

In traditional surrogacy, the surrogate woman's eggs are not used. Therefore, she is not the biological mother of the future child. Actually, in this, the eggs and sperm of a couple or donor, deprived of the happiness of having a child, are combined and then inserted into the uterus of the surrogate mother. In such a situation, the surrogate mother does not have any kind of genetic relation with the future child.

There are strict laws regarding surrogacy in India. To choose the option of surrogacy, the couple must fulfill the following criteria -

  • Only needy Indian couples, i.e. those unable to produce children, have the right to choose the option of surrogacy.
  • The couple has been married for at least five years and should have a certificate of infertility from a doctor.
  • The wife's age should be between 23 to 50 years and the husband's age should be between 26 to 55 years.

The first process of surrogacy is to find a surrogate mother i.e. a woman who is ready for surrogacy. Mainly according to the new rules, the surrogate woman should be married and a relative of the couple. To become a surrogate mother, it is necessary to know some more criteria. These criteria are as follows -

  • Age – The age of the female candidate should be between 25 to 35 years. A woman can opt for surrogacy only once in her lifetime, whereas earlier it was thrice.
  • Reproductive Background – The woman must have had at least one pregnancy without any complications and has had a child of her own.
  • Lifestyle – The lifestyle of the surrogate should be good. The environment where she is living and her way of living should be right. Do not consume alcohol or drugs.
  • Test – The mental health of the surrogate should be tested. Along with this, there should also be a complete physical examination, which includes testing for sexually transmitted infections (STIs).

Once the couple finds a surrogate mother, the process of surrogacy depends on the type of surrogacy process they want to go with –

For Gestational Surrogacy

Under this the following process is followed -

  • First of all the surrogate mother is selected.
  • Then a legal contract is made and reviewed.
  • Now coming to the process, an embryo is created using the egg of the intended mother or donor and the sperm of the intended father or donor.
  • The embryo will then be transferred to the surrogate woman. If this process is successful, the surrogate woman can conceive. However, if this process is unsuccessful, the intended parents and surrogate can undergo another IVF process. 
  • As soon as the child is born, the parents can take custody of the child as per the terms written in the contract.

For Traditional Surrogacy

Traditional surrogacy is done in this way -

  • For this process also, first of all a surrogate mother will have to be selected.
  • After selection of a surrogate mother, there is a need to make a legal contract in this also.
  • The IUI procedure is performed using the sperm of the intended father or a donor.
  • If this process is successful, there will be no problem.
  • Whereas, if the first attempt is unsuccessful, then an attempt is made again.
  • As soon as the baby is born, the couple has to complete the adoption process.
